Workplace Harassment II

(45 - 75 mins. for employees; 75 - 120 mins. for managers/supervisors): This course explores the reality of working in a diverse environment as well as the tools that managers and employees can use to recognize, accept and value differences in the workplace. Participants examine what behaviors and attitudes reflect stereotypical thinking, how those behaviors or attitudes affect the people involved and how stereotypical thinking can negatively impact effective teamwork. Users also learn the legal implications of bias and discriminatory behavior, so as to minimize potential liability for the organization. Finally, employees and managers are introduced to the organization's diversity goals and policies. They learn the working definition of diversity and the values of a diverse organization.

Equal Employment Opportunity
(60 - 90 mins. for managers/supervisors): This manager-only course teaches learners about the fundamentals of workplace discrimination throughout the employment lifecycle - from hiring, to performance management, to terminations. Expanding far beyond workplace sexual harassment (a subset of discrimination), the program addresses both disparate treatment discrimination and disparate impact discrimination under all of the federally protected categories. Based on the US Supreme Court's 1999 Kolstad decision, the program is designed to help employers establish a defense to punitive damages associated with workplace discrimination.

Lawful Hiring
(45 - 75 mins. for managers/supervisors): This course trains managers on the typical "legal landmines" associated with hiring, from selecting potential candidates, to the interview process, to finalizing the job offer and description. Managers learn the fundamentals of discriminatory hiring practices, negligent hiring, fraudulent inducement and violations of applicant privacy. The program also focuses upon practical guidelines that are essential to avoiding legal liability and making effective hiring decisions. Managers learn best practices associated with a variety of hiring issues such as appropriate interview questions, complete and accurate job descriptions, effective background checks and proper documentation.

Lawful Terminations
(30 - 45 mins. for managers/supervisors): This course addresses the critical employment law issues that arise from employee misconduct, poor performance and ultimately, termination. Managers learn the fundamentals of progressive discipline, effective documentation and how to communicate a decision to fire. The course covers a range of key legal concepts, including "at-will" employment, wrongful termination, constructive discharge and defamation. Managers also learn the practical guidelines that are essential to ensuring effective and lawful terminations such as proper documentation, well-crafted performance evaluations and appropriate communication processes.

Cyber Policy
(approximately 60 mins. for both employees and managers/supervisors): This course helps an organization to build a customized "Cyber Policy" (a policy that manages the use of electronic resources such as e-mail and the Internet). It then creates a custom training program to demonstrate the key contents of that policy to both employees and managers. The course covers critical employment law issues such as workplace privacy, electronic monitoring and surveillance, inappropriate use of e-mail and the Internet, copyright, trademark and electronic security.

Workplace Privacy
(20 - 30 mins. for employees; 50-65 mins. for managers/supervisors): This course addresses the dramatic increase in employment law issues concerning privacy over the past ten years. With a focus on the electronic workplace, the program helps the employer to manage the delicate balance between employee privacy and the employer's right to access the workplace for business and security reasons. The course addresses employee expectations of privacy, protection of sensitive information and data, proper procedures for handling medical and personnel information, as well as "lifestyle discrimination."

Workplace Violence
(45 - 60 mins. for employees; 60 - 90 mins. for managers/supervisors): This course teaches learners to recognize and respond to the early warning signs typically associated with workplace violence. Employees learn how to better manage workplace conflict and to report potential workplace violence incidents. Managers learn how to respond to workplace violence issues, including reporting and documentation. The manager course reviews some of the key legal concepts associated with workplace violence, including liability for negligence and federal OSHA standards.

Workplace Harassment I
(Average 60 - 90 mins. for employees; 90 - 135 mins. for managers/supervisors): This course focuses upon sexual harassment, and also trains learners on the fundamentals of broader workplace harassment prevention, addressing all of the federally protected categories under Title VII. Based on EEOC guidance, the 1998 US Supreme Court decisions in Faragher and Ellerth, as well as requirements established under state-specific sexual harassment and discrimination laws such as California (AB 1825; Gov. Code §12950.1) and Connecticut (Conn. Gen. Stat. § 46a-54(15)(B)), the program is designed to ensure compliance and to help organizations establish a powerful affirmative defense to sexual harassment and other forms of prohibited workplace harassment. Employees learn about expected standards of conduct within the organization, available remedies, as well as reporting obligations and procedures. Managers learn how to recognize, prevent and respond to claims of sexual harassment.

 

Antitrust: Abuse of Market Power
(60 minutes): Antitrust: Abuse of Market Power covers advanced antitrust laws and the guidelines and behavior employees need to know, understand, and implement in order to mitigate antitrust risk. The course provides clear direction on how to avoid antitrust violations when setting prices and determining sales strategy, as well as how to avoid even the mere appearance of antitrust behavior. The course covers, in detail, potential antitrust violations including predatory pricing, product tying arrangements, restraint of trade, and price discrimination. The course follows the story of one employee who violates antitrust law by attempting to put a competitor out of business in order to gain the number one market position. At the end of the course, the learner is asked to revisit the employee's story and help her make correct decisions to avoid antitrust behavior. Additional scenarios and activities are used throughout the course to illustrate appropriate behavior in given situations and to help ensure learner understanding.

Antitrust Essentials: Communication with Competitors
(60 minutes): Antitrust Essentials: Communication with Competitors covers basic antitrust laws as well as the guidelines and behavior employees need to know, understand, and implement in order to mitigate antitrust risk. The course provides clear direction on the importance of independent decision making, carefully limiting communications with competitors to those supervised by legal counsel, cutting off inappropriate conversations, and avoiding even the mere appearance of antitrust behavior. The course covers, in detail, the most common types of antitrust violations, including market price fixing, bid rigging, market and customer allocation, and illegal boycotts. The course follows the story of one employee who is lured by a competitor into committing multiple antitrust violations. At the end of the course, the learner is asked to revisit the employee's story and help him make correct decisions to avoid antitrust behavior. Additional scenarios and activities are used throughout the course to illustrate appropriate behavior in given situations and to help ensure learner understanding.

Avoiding Conflicts of Interest
(60 minutes): Avoiding Conflicts of Interest explains what conflicts of interest are, how they typically arise, and how they should be handled and resolved. The course provides clear direction on how to recognize situations that are likely to present an actual or perceived conflict of interest and how to avoid creating even the mere appearance of such conflicts. The course covers in detail the four areas in which conflicts of interest commonly arise: gifts, gratuities, and entertainment; doing business or working with family members; investments in other companies; and competing with your employer.

(30 minutes): Careful Communications and Effective Document Management presents users with the guidelines and tools necessary to practice careful communication and effectively manage all documents in the workplace. It provides them with multiple scenarios to assist in understanding each method of effective document management, and instills the importance of consistent and regular adherence to company policies and procedures regarding careful communications and document management.

EU Competition: Abuse of Market Power

Recent high profile cases involving major corporate giants have highlighted an alarming number of financial reporting problems. An organization's financial statement is the primary tool stakeholders use to make investment decisions. This course covers the basics of financial integrity and assurance and tests learners on best practices, gray areas, and warning signs of financial misconduct using interactive scenarios and real-life case studies.

Major Forms of Illegal Business Practice — Recognizing & Avoiding
(45 minutes): Recognizing & Avoiding covers domestic laws concerning illegal business practices. Through the use of case studies and a brief overview of applicable laws, this course discusses how participating in unfair and illegal business practices negatively affects everyone involved, from individuals and organizations to the economy as a whole. The program covers the six most common forms of illegal and inappropriate business activities in this category, including:
- Offering a Bribe

Protecting Confidential Information

The course provides a clear understanding of what confidential information is, why it must be protected, and how it can be safeguarded. The course covers in detail four main ways to protect confidential information: managing documents effectively, maintaining computer security, preventing social engineering, and communicating securely.
